Department of Health Closes Investigation of Registered Nurse with a Finding of No Probable Cause
The Probable Cause Panel for the Board of Nursing recently closed its investigation of a Registered Nurse accused of unprofessional conduct and diversion of controlled substances. After consideration of the response prepared by the Firm on behalf of a Registered Nurse, the Probable Cause Panel determined that probable cause did not exist and directed that the case against a Registered Nurse be closed by the Florida Department of Health avoiding the filing of an Administrative Complaint and implementation of an Emergency Suspension Order. After investigating the facts and circumstances surrounding the allegations that the Registered Nurse misappropriated controlled substances and was working while under the influence, the Firm identified several inconsistencies in the record confirming that the Registered Nurse had not acted improperly and had not violated the Nurse Practice Act.
